Terms of Service
These Terms of Service ("Terms") govern your use of the website wanderbuk.com and the digital scrapbook and photobook creation service operated by Wanderbuk ("we", "our", or "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Wanderbuk provides a browser-based tool that lets you create digital scrapbooks and photobooks from your photos and text, share them via a private link, download them as PDF files, and order printed physical copies. The Service is available to users worldwide. Some features require a paid Premium subscription.
2. Accounts
You must be at least 13 years old to create an account. You may register with an email and password or via Google Sign-In. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at contact@wanderbuk.com.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. User Content
You retain full ownership of the photos and content ("User Content") you upload to the Service. By uploading User Content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and process it solely for the purpose of providing the Service to you (including rendering previews, generating PDF downloads, and fulfilling print orders).
You represent and warrant that:
- You own or have the necessary rights to all User Content you upload.
- Your User Content does not infringe any third party's intellectual property, privacy, or other rights.
- Your User Content does not contain illegal material, child sexual abuse material, hate speech, or content that incites violence.
We do not claim ownership of your content and will not share it with third parties except as described in our Privacy Policy.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload content that is defamatory, obscene, or infringes third-party rights.
- Attempt to gain unauthorised access to any part of the Service or its systems.
- Use automated scripts, bots, or scraping tools to access the Service.
- Resell or commercially exploit the Service without our written permission.
- Upload malware, viruses, or any other harmful code.
5. Subscription and Payments
A free plan is available with limited features (currently one scrapbook). Premium plans are available on a monthly or annual subscription basis. Prices are displayed on our Pricing page.
Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from your account settings. Refunds are not provided for partial subscription periods, except where required by applicable law.
Print orders are separate one-time purchases. Once a print order is submitted and production has begun, cancellations may not be possible.
6. Intellectual Property
All content on the Service that is not User Content — including the Wanderbuk name, logo, website design, software, templates, and text — is owned by Wanderbuk or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary content without our written permission.
7. Privacy
Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to our data practices as described in the Privacy Policy.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for any loss of User Content due to technical failures; we recommend keeping copies of your photos and scrapbook files.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Wanderbuk and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or your use of the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD 50.
10. Termination
You may delete your account at any time from within your dashboard. Upon deletion, your personal data and uploaded photos will be removed within 30 days.
We may suspend or terminate your account immediately if you breach these Terms, without prior notice or liability. Sections 3 (ownership representations), 6, 8, and 9 survive termination.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you by email at least 7 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
